Easements and Encroachments on a Property


What is Property Easement?

Property easement is defined as the right to facilitate a fraction of a property for a specified purpose. A survey will help decipher the property boundaries that will prevent any issues from determining land ownership. An easement can allow another person to encroach on your property and even though the lines are declared within the survey, these boundaries may be crossed without the owner’s express permission.  An easement can be included in the title or deed to the property. A prime example of an express easement would be if the power company wanted to run power lines onto a property or a neighbour might even want to enter an agreement to share common parts of the property that extend into both boundaries.  

A prescriptive or implied easement can occur if the use of property continues over an extended period of time.  A good instance of this would be if a neighbour has been crossing a boundary line for years then that neighbour could have obtained a prescriptive easement that will allow him to legally cross the property line.  Also, a “right of way” easement is nothing more than the allowance of someone to cross onto the property in question.  

Many people forget when they are buying a house that they are actually purchasing the land the house is built on and the boundary that surrounds it.  If you were to build a shed in your back yard and it happened to cross the land boundary into the property of another person this could technically be handled in a legal manner. This is something that can be avoided with proper surveys being done and the use of specified easements.

What about Title Insurance?

Title Insurance is a policy issued to the mortgage lender to protect against a defect in title. In Saskatchewan, the Land Titles system guarantees ownership of your land by title. Title Insurance policies provide no information about your property.

Only a Surveyor’s Real Property Report can assure you of the extent of your property and warn of any possible problems. Most of the time people are not going to worry about a few yards here and a few yards there, however, the same people who are okay with the encroachment might not always live there so it always is a good idea to get your bases covered legally and legitimately. This will ensure that down the road you are not going to wind up paying fines and going through a legal process that will cause nothing but problems.

Keeping ourselves healthy is a goal we can all share, and fortunately, there are steps we can take to boost our chances of staying well and fighting off infections. One is as easy as staying hydrated.


“Water is vital for the functioning of all of your organs, and it’s a huge part of keeping your immune system functioning at an optimal level,” says Dr. Jyothi Tirumalasetty, assistant professor of medicine at UCLA Health in the department of clinical immunology and allergy. “We are made of 60 percent water. If we are dehydrated, the whole system of immunity could start breaking down.”


Proper hydration, along with adequate nutrition and sleep, is an essential component of a healthy immune system.

Dehydration Makes Us More Susceptible to Germs

Dr. Tirumalasetty describes the immune system as “our own private bodyguard” against infections and other harmful elements. It’s comprised of multiple components that include cells, tissues, and organs. One of those organs we know well: our skin. “It’s a barrier that protects you,” she says. When our skin barrier is impaired, it can become an open door for pathogens like bacteria and viruses to enter our bodies.

The immune system includes T cells that fight infection and work with B cells, which produce proteins called antibodies that travel through the blood. “Those antibodies are going to recognize pathogens and start switching around,” she says. “When they meet a new bacteria they say, ‘Oh, I need to change and learn to recognize this.’ The next time that enters your body, that antibody is going to attack it with full force.”

Dr. Tirumalasetty describes water as “a solvent” that helps these and other elements of the immune system work together. “Water carries important components of the immune system, including nutrients, to where they need to go and carries away waste from organs that are the byproducts of our everyday metabolism as we consume food and turn it into energy,” she says. If not flushed out, that waste has the potential to become toxic and weaken the immune system.

Make Hydration a Priority

In 2004, The National Academies of Sciences, Engineering, and Medicine set general recommendations for daily water intake for healthy, sedentary people in temperate climates: about 2.7 litres (91 ounces) of water for women and about 3.7 litres (125 ounces) for men. The researchers found about 80 percent of people’s total water comes from drinking water and other beverages; the other 20 percent is derived from food.

However, Dr. Tirumalasetty stresses to her patients to switch to water instead of drinking more unhealthy options like juice and soda. She also says the amount of fluids individuals should drink largely depends on a number of factors. People who exercise a lot or are in hot climates likely need more than the recommended amount, for instance. Likewise, older adults with heart disease or kidney disease may need to limit their water intake if their bodies can’t regulate so much fluid.

The doctor says one universal rule is that by the time you’re thirsty, you’re already dehydrated. Plan to drink plenty of water with meals and, if necessary, find ways to trick yourself into drinking it. Add flavoring to water, she says, or heat it up and add herbal tea. You should also eat water-rich foods, which include watermelon, strawberries and spinach.

“It’s just like getting eight hours of sleep and eating properly,” Dr. Tirumalasetty says. “Getting enough water is a huge component of wellness in my mind.”

  3. Remote Data Access – This style of access data at the office is newer than the 2 options above and is set to be a disrupter in this area. Using zero trust as a starting point of access to your data from any device, never actually moving the data offsite and yet still providing access to all your data. It is difficult to describe how this works in a short article, so I found this video from FileFlex which explains beautifully.

#4 Backup For Everyone

With more staff now working from home, whether they are on a work laptop or their home computer, the need for a managed backup is paramount. As data gets slowly moved away from your central office server it would be beneficial if all your home computers backed up to a central point where it can be easily recovered.


And, while I am talking backup, a backup that is not tested is not a backup. You should test recover some of your data at least once per month, nothing sets of a panic like a backup which is thought to have worked, but in fact fails when the day comes that you need to recover. – Thanks Gareth

In April 2020, Brodie Johnston, owner of Flash reached out to The Trusted Saskatoon team with an idea. He had been approached by good friends at Hudson Bay Distilleries to see if he wanted to buy or distribute hand sanitizer. In this time of Covid, it was a pretty rare commodity and Hudson Bay Distillers was one of the handful of distilleries around the province that had been approved by the Saskatchewan Government to shift their focus from selling alcohol to making and distributing hand sanitizer.  
Brodie is an entrepreneur and saw the opportunity to do well, but being the community-spirited guy he is, he immediately thought about how he could help instead of profit from this opportunity! 

A Fundraising Campaign


Knowing the massive negative impact on small local business in our community due to the pandemic, but also recognizing he can't help every small business in need in Saskatoon,  he decided the best thing was to support the Trusted Saskatoon partners in the community he belongs to that have been hardest hit financially from the Covid Pandemic lockdowns in Saskatoon. Once he shared the idea with Sara Wheelwright, the owner of Trusted Saskatoon, she was thrilled to be able to step up and help.

Jumping on a trampoline exercises the whole body. The g-force that bouncing produces helps to build muscle and burn fat quickly. This firms up every part of your body – including legs, thighs, arms, hips and stomach. It also has the added benefit of improving agility and balance. In our latest fitness article, we share the history of bouncing, some bouncing options and the trampoline options we have in store at Fitness Solutions in Saskatoon.   
The modern trampoline was created by George Nissen in Cedar Rapids, Iowa, in 1936. In 1938 the first “small trampoline” was created by Ed Russell, who left his ideas and prototype with Victor Green, who patented the “small trampoline” in 1975. Within a year, five American companies were manufacturing small trampolines, which were soon called rebounders.

Also known as rebounding—is an exercise that takes place on a trampoline. The exercise gained popularity in 1980 when NASA began using rebounding to help astronauts regain bone density after returning from space. This came on the heels of a study published in the Journal of Physiology that found rebounding is 68 percent more efficient than running.

“Rebound Exercise is the most efficient, effective form of exercise yet devised by man.”


Today, there appears to be an upsurge of interest in rebound exercise, in part due to the increasing quality of equipment and in part due to its use in physical therapy and the fight against obesity generally. Rebound exercise begins as soon as someone steps on a rebounder and begins to move their body. It can be highly aerobic — full-on sprints and interval training are ideal on a rebounder because it does not jar the physical body anywhere near as much as does hard ground — or it can be very slow and gentle, with only a gentle rocking taking place.

Full-Size Trampolines- Not Just For Kids 

If you have a trampoline in your backyard - or if you are considering one for your children, you can use it too!  We understand that not everyone is skilled enough or confident enough to do backflips, but that doesn't mean you have to avoid jumping on yourself. Below are a few additional ideas for incorporating a full-size trampoline into your workout routine.

Upper-Body Drills

Target your upper body by doing the plank-to-pushup exercise on the trampoline. Get down into a plank position so your body forms a straight line and you are supporting your weight on your forearms and feet. Push yourself up onto your hands and then do a pushup to complete one repetition. ground. Push yourself back up into the starting position and repeat. The instability of the surface makes this much more challenging in a trampoline - this equals more benefits for you.

Tackle the Lower Body

To work your lower body do lateral plyo jumps by standing on your left foot on the left side of the trampoline. Quickly jump to the right side, landing on your right foot to complete one repetition. Continue hopping from side to side as quickly as you can. You can also perform squats, lunges, jogging in place, high knee running or jumping jacks while on the trampoline.

Condition Your Core

The power bounce with lateral reach exercise helps strengthen your abdominals, lower back and hips. Sit on the trampoline and hop back up into a standing position as quickly as you can. Reach alternate arms across your chest every time you stand back up. You can also do crunches by sitting on the trampoline with your hands to your chest and your knees bent at 90-degree angles. Lean back so that you are balancing on your buttocks. Crunch your torso toward your knees without resting your lower back on the trampoline.
